I would not say it boils down to that, no, because I was not trying to provide a definition in this specific post (I've talked about the subject often enough before that I didn't think defining it was necessary over here tbh). My post was about my objections to defining fanfic as an artistic genre/form based entirely on legal and marketing concerns that don't even reflect the term's usage among fans. The idea that my AU fanfic on AO3 about a genderbent Prince Hal is not really fanfic because Shakespeare's Henriad plays are out of copyright is pretty obviously absurd in a fandom context, and "fanfic" as a term and a concept is rooted in fan activities and communities.
